The voluntary immobilization of registered goods or rights

The voluntary immobilization of registered goods or rights, that are registered at the General Property Registration, is guaranteed and safeguarded by law in our legal environment for the benefit and legal certainty of the owner and / or their representatives (in special cases).

The Republic of Guatemala guarantees and provides the necessary mechanisms to safeguard property owners at the General Property Registration, his detention, in the sense that these are not disposed or encumbered without the consent of the owner, thereby avoiding any bad practice that might prejudice them with undermining the Safety registrar.

Thus, through the entry into force of Decree No. 62-97 of the Guatemala Republic Congress, was decreed the "The Voluntary Immobilization of Registered Goods Law"; in which stipulates, preserves and determines the procedures to be follow to ensure the property immobilization or freeze. Such restraint consists in, that the owner can not dispose of his property during the term of immobilization, and if an operation or transaction is generated, the General Property Registration when verifies the detention in that good, it would suspend the registration of that operation or transaction, unless is requested the cancellation of this asset.

It is advisable to freeze your property, when the owner is intended either in short or medium term dispossessing it (sell, give, donate, swap, etc.) or guarantee (mortgage, pledge, etc.)Also to assure the safety registral cannot be operated any of this transactions in some cases in a fraudulent way at the General Property Registration. Such restraint is the exception of how can be operated documents and annotations derived from an injunction, where the prevailing judicial authority and is useful to guarantee the result of a trial.

You can freeze your property for days, weeks, months or years, but the maximum period is 3 years, of being possible to reapply for a similar or different period, as often as necessary. The owner of the property or rights or their representatives, should apply with a writing document for the restraint, with reestablished law requirements, signed by the applicant, who may be the owner of the property or right, or his representative, depending on the case, and also your fingerprint needs to reflect on that request for safeguarding the identity of the applicant. Such request must be authenticated by a skilful exercise notary.

To cancel the endorsement cancellation during the annotation of immobilization, the owners of the property or right, or their representatives, as appropriate, must apply for writing documents, attaching various notarized documents, that authorize the decision of cancellation and between what stands out, the presentation of a report by an expert that through technical - scientist means, has confirmed the authenticity of the fingerprint embodied in the original application or the current representative, in case that has been modified during the force of this measure.
